Platform Usage & Compliance Attestation (A23)

This Platform Usage & Compliance Attestation (“Attestation”) is entered into between In Your Hand, Inc. (“IYH”, “we”, “our”) and the individual user opening or operating a fundraising project on the platform (“User” or “Project Owner”).

By accepting this Attestation, the User makes a legally binding declaration regarding lawful, ethical, and compliant use of the platform.

• Understand and accept all platform rules and obligations.
• Acknowledge applicable legal and regulatory requirements.
• Commit to truthful, ethical, and lawful use of the platform.
• Accept ongoing monitoring, verification, and compliance review.
• Accept personal responsibility for actions taken through the account.

The User attests that they have read, understood, and accepted all applicable agreements and policies, including but not limited to:

• Terms of Service.
• Project Owner / Fundraiser agreements (including any master agreement).
• Refund & Financial Responsibility Agreement.
• Data privacy notices (GDPR / CCPA aligned).
• AML / OFAC / KYC-related obligations, where applicable.
• Media, branding, safeguarding, and ethical storytelling rules.
• Recordkeeping, transparency, and reporting requirements.
• Conflict of interest rules.

The User agrees to comply with reasonable updates to platform policies as they are published.

The User declares that:

• All information provided to IYH is accurate, complete, and truthful.
• No material facts have been omitted or misrepresented.
• All submitted documents (IDs, invoices, receipts, reports) are authentic.
• Information will be updated promptly if circumstances change.

Providing false or misleading information constitutes a material breach of this Attestation and may result in enforcement actions.

The User agrees to use the platform solely for lawful charitable purposes and not to engage in:

• Illegal fundraising or deceptive activity.
• Fraud, money laundering, or terrorist financing.
• Evading sanctions or screening requirements.
• Projects with harmful, misleading, or abusive intent.

Any unlawful use may result in immediate suspension or termination, and reporting to authorities when legally required.

The User acknowledges and agrees that IYH may:

• Monitor account activity and transactions for compliance and safety.
• Request additional documents or explanations.
• Conduct audits, interviews, or field/remote verification when needed.
• Withhold or delay disbursement if verification is incomplete or risk is detected.

Failure to cooperate may result in suspension, fund withholding, denial of service, or project closure.

The User commits to:

• Treat beneficiaries and donors with dignity and respect.
• Avoid exploitation of vulnerable individuals or communities.
• Comply with safeguarding rules, especially regarding children.
• Follow ethical storytelling and media standards.
• Avoid harassment, discrimination, or abusive conduct.

The User is strictly prohibited from:

• Contacting donors directly outside the platform for fundraising or payment.
• Extracting, misusing, or sharing donor data.
• Circumventing platform systems, controls, or monitoring.
• Bypassing compliance or screening procedures.
• Uploading harmful, offensive, or inappropriate content.

The User acknowledges that:

• They are solely responsible for all uploaded content.
• All media must comply with ethical and legal standards.
• Necessary permissions and consents must be obtained.
• IYH may remove content that violates platform rules.

The User understands and agrees that:

• Funds may only be used for approved project purposes.
• Misuse or misallocation of funds may trigger repayment obligations.
• Complete and truthful documentation is mandatory.
• Refund obligations may apply under the Refund & Financial Responsibility Agreement.
• Personal financial liability may arise from misconduct.

The User acknowledges that:

• Identity and sanctions screening may be mandatory.
• Ongoing monitoring may occur throughout platform usage.
• Additional documentation may be required at any time.
• Non-compliance may result in suspension or termination.

The User agrees to:

• Report suspected fraud, misuse, or safeguarding concerns.
• Notify IYH within 24–48 hours of serious incidents affecting project integrity or safety.
• Disclose conflicts of interest promptly.

The User understands that violations may result in:

• Warnings, corrective actions, or additional verification requests.
• Temporary or permanent account suspension.
• Freezing, withholding, recovery, or recall of funds.
• Project termination and bans from the platform.
• Legal or regulatory reporting where required.

By accepting this Attestation, the User certifies that:

• They fully understand the obligations described above.
• They voluntarily agree to comply with platform rules and monitoring.
• They accept personal legal responsibility for their actions.
• They commit to ethical, lawful, and transparent use of the platform.

By clicking “I Agree” (or equivalent) and typing their full legal name in the verification flow, the User:

• Provides a legally binding electronic signature.
• Consents to electronic records and disclosures.
• Acknowledges this Attestation is enforceable under applicable law.
