Project Owner Master Agreement (Account Terms)

These Account Terms & Conditions apply to individual users who create an account, donate, and/or open and manage personal fundraising projects on the In Your Hand platform.

1. Purpose of This Agreement

This Agreement governs the terms under which an individual may create and maintain an account on the In Your Hand platform, donate to projects, open and manage personal fundraising projects, upload content, documents, and reports, and interact with the platform community.

Use of the platform constitutes full acceptance of these Terms & Conditions.

2. Eligibility Requirements

The User confirms that:

  • They are at least 18 years old.
  • They are legally capable of entering into a binding agreement.
  • They will use true and accurate personal information.
  • They are not currently restricted by law from using online charitable platforms.

3. Accuracy of Information

The User agrees that all information provided during registration or project creation is true, complete, and accurate.

  • False declarations, fake documents, using another person’s information, or hiding information is strictly prohibited.
  • In Your Hand may suspend or close the account if inaccurate information is detected.

4. Criminal Background & Misconduct Responsibility

The User declares that:

  • They are not currently under investigation or conviction for fraud, corruption, money laundering, terrorism financing, sexual exploitation, or violent crimes.
  • They will not conceal relevant criminal history.
  • In Your Hand is not responsible for crimes committed by the User; the User bears full legal responsibility for their actions.
  • Providing false information about criminal background may result in immediate termination.

5. AML / OFAC Compliance & Screening Consent

The User agrees that In Your Hand may conduct AML and OFAC sanctions screening using global databases.

  • Name, identity details, and activity logs may be checked to ensure compliance with U.S. and international laws.
  • Additional verification may be requested (government-issued ID, proof of address, selfie/biometric confirmation).
  • The User will not use the platform for money laundering, illegal fundraising, terrorism financing, or fraudulent schemes.
  • Suspicious activity may be reported to authorities when required; failure to cooperate may lead to denial/suspension.

6. Permitted Use of the Platform

The User may:

  • Donate to projects.
  • Open personal fundraising campaigns (after approval).
  • Upload required documents.
  • Communicate respectfully with the platform team.
  • Access transparent reporting and project updates.

The User must:

  • Use the platform for lawful charitable purposes.
  • Follow all published policies and guidelines.
  • Ensure uploaded content complies with ethical and legal standards.

7. Prohibited Actions

Users are strictly prohibited from:

  • Providing false, misleading, or fraudulent information.
  • Raising funds for illegal, harmful, or undisclosed purposes.
  • Uploading false invoices or fabricated project reports.
  • Misusing donor money.
  • Impersonating another person or organization.
  • Uploading harmful, offensive, or abusive content.
  • Exploiting children in photos or videos.
  • Attempting to bypass In Your Hand’s financial controls.
  • Contacting donors to request money outside the platform.

Any violation may lead to suspension, termination, or legal action.

8. Opening a Personal Project

The User may open a project only if they:

  • Provide a clear project description and truthful purpose.
  • Upload a valid Project Intent Letter.
  • Provide a realistic budget.
  • Commit to using all raised funds only for the declared purpose.
  • Submit documentation to prove fund usage (invoices, photos, delivery evidence).
  • Accept monitoring, evaluation, and verification processes.

In Your Hand reserves the right to approve, modify, or reject any project.

9. Fund Disbursement to Individual Users

Disbursements may occur only if:

  • The User has passed identity verification.
  • The project has been approved.
  • Compliance conditions are met.
  • Sufficient documentation has been uploaded.

In Your Hand may release funds in tranches or hold funds until adequate evidence is provided. In case of misuse or suspicion, funds may be frozen.

10. Fund Usage Responsibilities

The User agrees that:

  • All funds are restricted donations and must be used exclusively for the declared project.
  • Funds cannot be used for personal benefit or unrelated expenses.
  • Receipts, invoices, photos, videos, and logs must be uploaded as proof.
  • Any financial irregularity may result in account suspension.

11. Donor Privacy & Confidentiality

The User agrees that:

  • Donor identity and contact information will remain confidential.
  • Users will not attempt to contact donors directly unless officially authorized.
  • Donor data may not be collected, copied, stored, or shared.
  • Violation of donor privacy is grounds for immediate termination.

12. Content Standards & Ethical Rules

The User must comply with ethical content rules, including:

  • No exploitation of vulnerable individuals.
  • No sharing of graphic or harmful imagery.
  • No identifiable photos of children without consent.
  • No defamation, hate speech, or political propaganda.
  • No misleading photos or staged beneficiary images.

All submitted content becomes subject to In Your Hand’s review.

13. Reporting & Transparency Requirements

The User must:

  • Upload progress reports.
  • Share real evidence of distributions.
  • Respond promptly to compliance inquiries.
  • Maintain accurate communication with the platform team.

Failure to provide reports may result in withholding of funds or closing the project.

14. Refund Policy for Donations

The User acknowledges that:

  • Donors may request a refund before funds are transferred to the User.
  • Once the User has received funds, the User may become financially responsible for refunds when required.
  • In Your Hand may issue refunds on behalf of donors and deduct refunded amounts from future disbursements.
  • Refund eligibility depends on project status and donation processing timelines.

15. Account Suspension & Termination

In Your Hand may suspend or terminate User accounts for:

  • Fraud or suspected fraud.
  • Non-cooperation during verification.
  • Violation of safeguarding rules.
  • Illegal activity.
  • Misuse of funds.
  • False information.
  • Harassment or inappropriate behavior.

Account termination may include:

  • Freezing funds.
  • Reporting to authorities.
  • Banning future access.

16. Liability Disclaimer

The User agrees that:

  • They alone are responsible for their actions, content, and projects.
  • In Your Hand is not liable for criminal acts, fraud, or misconduct of the User.
  • In Your Hand is not responsible for external vendor failures or field errors.
  • Platform availability is not guaranteed at all times.

17. Amendments to Terms

In Your Hand may update these Terms as needed. Continued use of the platform constitutes acceptance of all updates.

18. Governing Law

This Agreement is governed by the laws of the State of New York, USA.

19. Acceptance & Signature

By creating an account, the User acknowledges:

  • They have read and understood these Terms.
  • They agree to comply fully.
  • They accept all legal responsibilities.
